These Terms of Service (ToS) govern your access to and use of the PerkHup website, as well as the general framework for the consulting and performance marketing services provided by our agency.
PerkHup is a B2B agency providing advanced marketing engineering services. Our core competencies include, but are not limited to:
Regarding traffic acquisition and advertising performance (ROAS, CPA), PerkHup commits to an obligation of means ("best efforts" basis) rather than guaranteed absolute outcomes. We pledge to deploy rigorous algorithmic strategies, continuous A/B testing, and elite technical expertise to maximize the profitability of the ad budgets entrusted to us. However, the agency cannot be held liable for market volatility, third-party algorithmic updates (e.g., Google, Meta), or internal client operational failures (e.g., inventory stockouts, logistical disruptions).
Our clients agree to strictly adhere to the advertising policies of our partner networks (Meta, Google, TikTok). We categorically refuse to collaborate with entities involved in deceptive practices, the sale of illicit products, or unsolicited mass communication (spamming).
Regarding our technical infrastructure, any attempt to exploit our tracking scripts, databases, or cloud servers for the dissemination of unsolicited emails (SPAM) or malicious cyber attacks will result in the immediate termination of the contract and formal reporting to relevant regulatory authorities.
The client retains full and exclusive ownership of their advertising accounts (Business Managers), tracking pixels, and first-party customer data (email databases). PerkHup operates solely as an agency partner holding "Partner Access" to execute and manage campaigns. Upon contract termination, the client retains the complete historical data of all campaigns, ad structures, and optimizations implemented during our tenure.
Specific details regarding billing structures (flat retainers or percentage of ad spend), minimum engagement periods required for algorithmic learning, and termination notice protocols are defined within the Master Services Agreement (MSA) or Statement of Work (SOW) signed individually with each client following the initial strategic audit.
